High-profile QC in shock wig claim

Things are getting a bit hairy for one Scottish solicitor who is facing legal action after allegedly making derogatory comments about one of the country's top-earning QCs, including mocking his toupee.

Solicitor Robert Davidson was giving a guest lecture at Edinburgh University's School of Law when he allegedly made the insulting comments about Herbert Kerrigan QC, a top Scottish QC (© all newspapers). Along with questioning Kerrigan's integrity, Davidson is also accused of telling students that the QC's nickname was "Two Wigs" because of his alleged penchant for sporting a hair-piece.

Unfortunately for Davidson, one of the students had connections with Kerrigan and the lecturer's comments filtered back to the thin-skinned silk who was "furious", according to a Daily Record report. So furious that he decided to ensure that the comments were put firmly into the public domain by launching a defamation action against Davidson.

Kerrigan told the daily Record: "it is in the hands of my lawyers. It would be inappropriate to comment on anything."

Perhaps Mr. Kerrigan will begin proceedings against the Daily Record for that most heinous libel of calling a barrister a solicitor.

Looking at the different styles one wonders whether the defences of truth, justification or fair comment could be used to defend the action. If it is true could "two wigs" be defamatory if there is in fact only one? Giving the QC's hair a good tug as the parties enter court could make or break the defence.
"It is in the hands of my lawyers....." may have undermined the action and provided some form of subliminal message which the defence will seize upon at trial.

Advocate. Not "barrister".
